29 CFR 1910.134(c)(2)(ii): The employer did not establish and implement those elements of a written program necessary to ensure that any employee using a respirator voluntarily was medically able to use that respirator: a) On or about February 10, 2015 the employer failed to implement aspects of the written respiratory protection program for employees who had half-mask and full-face tight fitting respirators available to them for voluntary use in that medical evaluations were not provided. Employees performing filter change outs of grinding equipment and portable dust collection units were exposed to dust hazards with the potential to contain crystalline silica.

29 CFR 1910.134(d)(1)(iii): The employer did not identify and evaluate the respiratory hazard(s) in the workplace; including a reasonable estimate of employee exposures to respiratory hazards and identification of the contaminant's chemical state and physical form: a) On or about February 11, 2015 the employer failed to evaluate respiratory hazards in the workplace and evaluate employees' exposure to air particulates (dust) with the potential to contain crystalline silica. Employees were exposed to hazards associated with dust during activities including, but not limited to, filter change outs of riding grinders and portable dust collection systems, and shoveling dust from the riding grinder dust pan in the maintenance shop.
