OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that the employees were exposed to a struck by hazard or caught in hazard from concrete beams:  (a)  Production and Finish Areas:  On or about February 13, 2015, and at times prior thereto, employees were exposed to a struck by and caught in hazard, when a Travelift MJ40 Crane (Serial: 1440) was used to lift and move concrete beams, with two Crosby hooks that did not have latches to secure the load.  (b)  Production and Finish Areas:  On or about February 13, 2015, and at times prior thereto, employees were exposed to a struck by and caught in hazard, when a Travelift MJ40 Crane (Serial: 1409) to lift and move concrete beams, with two Crosby hooks that did not have latches to secure the load.  (c)  Production and Finish Areas:  On or about February 13, 2015, and at times prior thereto, employees were exposed to a struck by and caught in hazard, when a blue strong back beam was used to lift and move concrete beams, with two Crosby hooks that had the latches tied down with wire.

29 CFR 1910.180(f): After adjustments and repairs had been made, the crane was operated before all guards had been re-installed, safety devices reactivated and/or maintenance equipment removed:  (a) Production and Finish Areas:  On or about February 13, 2015, and at times prior thereto, employees were exposed to a caught in hazard, while walking alongside the Travelift MJ40 Crane (serial: 1440) without a left front wheel guard that was missing.  (b) Production and Finish Areas:  On or about February 13, 2015, and at times prior thereto, employees were exposed to a caught in hazard, while walking alongside the Travelift MJ40 Crane (serial: 1409) without a right rear wheel guard that was missing.
