OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees from not ensuring operators of winches had the required training and employees were protected from contact with the winch line during operations:    (a) Jobsite, 3097 Morgantown Road, Smithfield, PA:  On or about February 18, 2015 the operator of the Ingersoll-Rand air winch, Serial #EU1251298 had not received an oral or written examination by the employer to ensure they were qualified to recognize, the following but not limited to: operational controls, responses to emergencies, the manufacturer's recommendations, equipment limitations, general operating practices, setup and hazard recognition.    (b) Jobsite, 3097 Morgantown Road, Smithfield, PA:  On or about February 18, 2015 the wire rope line on the Ingersoll-Rand air winch, Serial #EU1251298 was under tension and was not used in a manner that protected employees from contact during operations.  An employee who was working from a suspended ladder grabbed the wire rope line that was being used to hoist a column.  The employee grabbed the line to move the column from the side of the structure.  There was a twist in the wire rope and the employee's left thumb became tangled.  As the rope continued to rise, the employee attempted to pull out his thumb and suffered an amputation.
