Listed, labeled, or certified equipment shall be installed and used in accordance with instructions included in the listing, labeling, or certification.  a. The relocatable power tap used on the mezzanine floor is not listed or labeled to be used for construction activities, it is listed and labeled for use in office and residential locations. The employees were exposed to  fire and electrical contact hazards.

29 CFR 1926.404(f)(6): Grounding path. The path to ground from circuits, equipment, and enclosures shall be permanent and continuous.    a. On the Mezzanine floor the employees were using a reciprocating saw plugged in to a relocatable power tap that was plugged into an extension cord. The relocatable power tap was missing the grounding pin and was used to energize the saw, thereby exposing employees to contact with electrical current.

29 CFR 1926.405(a)(2)(ii)(I): Flexible cords and cables shall be protected from damage. Sharp corners and projections shall be avoided. Flexible cords and cables may pass through doorways or other pinch points, if protection is provided to avoid damage.   a. The extension cord used to power a Dewalt reciprocating saw was damaged, thereby exposing employees to contact with electrical current.

29 CFR 1926.855(f): When floor arches are being removed, employees shall not be allowed in the area directly underneath, and such an area shall be barricaded to prevent access to it.  a. While floor arches from the mezzanine were being removed the employer failed to block of the area below to ensure the safety of employees, thereby exposing them to a struck by/caught under hazard.

29 CFR 1926.501(b)(1): "Unprotected sides and edges." Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level shall be protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.  a. Employees were working on the mezzanine floor with out fall protection. The open sided floor was two feet wide and the distance to the next lower level was 12 feet 4 inches. The floor below the mezzanine was covered in debris from the demolition, the employees were exposed to a 12 foot fall hazard.   Installed Building Products was previously cited for a violation of this occupational safety and health standard or its equivalent standard, which was contained in OSHA inspection number 990714, citation number 1, item number 4 and was affirmed as a final order on January 14, 2015, with respect to a workplace located at 36 Forest Street, Lexington, MA 02421.
