29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: (Construction Reference 1926.103)     (a) Location: 4 Burlington Road, Burlington MA, 01803     On or about 4/10/2015, the controlling contractor required that a subcontractor temporary labor employee wear an N95 Dust Mask Respirator in a work application before a medical evaluation determined that the employee had the ability to safely use the respirator.
