OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards from heavy excavator:    Jobsite:    An employee who crossed behind an excavator was struck and suffered a serious injury/  The employee did not effectively enforce means and methods to protect employees from being backed over by an excavator.    Among feasible abatement measures are:    1) Erecting barriers around excavators to prevent access to excavators;  2) Sounding the excavator horn before the excavator is moved;  3) Using a signal person to prevent employees from entering the area around the excavator;  4) Establishing a procedure for employees passing in front of or behind excavators to ensure that they are seen by the operator; and  5) Training employees in the proper procedures to avoid and prevent struck-by and crushing injuries associated with working in proximity of an excavator.
