29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:  a) Jobsite: On or about April 15, 2015 and times prior thereto, employees performing roofing work did not utilize their donned personal fall arrest systems and/or equipment and were exposed to fall hazards from 11 feet up to heights of 22 feet on this 8 in 12 pitch residential roof structure.    Note: Abatement certification and documentation ARE required for this item.

29 CFR 1926.503(a)(2)(iii): The employer did not assure that each employee had been trained, as necessary, by a competent person in the use and operation of guardrail systems, safety net systems, warning line systems, safety monitoring systems, controlled access zones, and other protection to be used:  a) Jobsite: On April 15, 2015 and times prior thereto the responsible person on site and employees performing roofing activities did recognize the hazards of roofing an 8 in 12 pitch roof without any means of fall protection and take actions to minimize or eliminate these hazards.
