29 CFR 1910.134(d)(1)(iii): The employer did not identify and evaluate the respiratory hazard in the workplace:    (a) Trade Star LLC, at 70 Acre Ranch, Kersey, CO: On and preceding 4/29/15, Trade Star LLC did not identify and evaluate the respiratory hazard in the workplace.  Employees performed gauging and sampling of crude oil at the oil well tank battery.  Employees performed these tasks at open thief hatches and adjacent to opened blow down vents.  Flammable hydrocarbon gases were vented through open thief hatches and blow down vents.  The employer did not evaluate employee exposure to respiratory hazards, including oxygen deficient atmospheres and hydrocarbon gases and vapors, including benzene.  This condition potentially exposed employees to respiratory hazards.

29 CFR 1910.1200(e)(1): Employer had not developed or implemented a written hazard communication program which at least describes how the criteria in 29 CFR 1910.1200(f), (g) and (h) will be met:  (a) Trade Star LLC, at 70 Acre Ranch, Kersey, CO: On and preceding 4/29/15, Trade Star LLC had not developed or implemented a written hazard communication program which at least describes how the criteria in 29 CFR 1910.1200(f), (g) and (h) will be met.  Employees were exposed to flammable and toxic gases and vapors, including methane, pentane, butane, and benzene, while performed gauging and sampling of crude oil at the oil well tank battery.  The employer had not developed a written hazard communication program.  This condition potentially exposed employees to chemical hazards.
