29 CFR 1926.701(b): All protruding reinforcing steel, onto and/or into which employees could fall or come against, was not guarded to eliminate the hazard of impalement At this construction site, at the entrance of this wastewater treatment tank, there were rebar stakes across tank entry area and most areas were left unprotected against impalements.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed. At the construction wastewater site, employees gained access to the wastewater tank, using a portable extension ladder with "No" extension of 3 feet above the top of wastewater tank. The employees were exposed to a fall hazard at approximately 15.8 feet or more above ground level.
