29 CFR 1910.178(q)(7): Industrial trucks were not examined before being placed in service, or were placed in service if the examination showed conditions adversely affecting the safety of the vehicle. Examinations were not made daily: Production Area: Mitsubishi-40 propane forklift truck had been in service although it had sustained damage that could affect the safety of the vehicle. Forklift Mitsubishi-40 had a problem with the starter, both back tires had chunks of rubber broken off or nearly broken off and the insulation for the hydraulic lines for the mast was cracked and flaking off.

29 CFR 1910.132(d)(1): The employer did not assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE): Production Area: Employer's PPE assessment did not include all elements required by this section such as: a) Selecting, and having each affected employee using, the types of PPE that will protect the affected employee from the hazards identified in the hazard assessment; b) Communicating selection decisions to each affected employee; and, c) Selecting PPE that properly fits each affected employee. The PPE assessment did not include selection and provision of PPE that would adequately protect against the following hazards: a) Employees who wear prescription glasses were not provided adequate eye protection while operating stationary (i.e. woodworking machines) and portable equipment. b) Employees who perform work mechanic work and clothing becomes soiled with combustible residue and perform hot work were not provided with a change of clothing. c) Employer did not ensure that suitable hearing protectors such as stand-alone ear muffs (not incorporated into a hard hat) were readily available at all times.
