Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a crush-by and/or drowning hazards in that they used a ride-on zero turn mower that was not equipped with a Rollover Protection System (ROPS) and an operational seatbelt, while mowing surfaces near a retention pond with slopes greater than fifteen degrees:      a)  At the pond located at the south-west side of the River Heritage and Grand Harbor Parkway intersection in Bradenton, FL,  an employee was operating a ride-on zero turn mower, TORO Z500 Master Model: 74248, S/N 260000826, with no roll over protection system in close proximity to a water retention pond. The mower tipped over into the pond and the employee was pinned under water by the mower and drowned on or about 7/20/2015.
