29 CFR 1910.1052(d)(2): Initial determination. Each employer whose employees are exposed to Methylene Chloride shall perform initial exposure monitoring to determine each affected employee's exposure: a. Employees, working in the fabrication/welding area of Fox Valley Metal Technology, were using an adhesive containing Methylene Chloride (MC) to sandwich a piece of Lead between two pieces of steel and in the process were exposed to the hazards associated with MC without initial exposure monitoring.

29 CFR 1910.1052(l)(1): The employer shall provide information and training for each affected employee prior to or at the time of initial assignment to a job involving potential exposure to Methylene Chloride (MC): a. Employees exposed to MC were not trained on the health effects of MC, nor were they trained on the provisions of 29CFR 1910.1052 Methylene Chloride Standard. Key elements of the MC Standard include, but are not limited to the following: 1. Exposure monitoring 2. Establishing regulated areas. 3. Respiratory protection. 4. Protective work clothing and equipment. 5. Providing hygiene facilities. 6. Medical surveillance. 7. Hazard communication. 8. Training program. 9. Record keeping.

29 CFR 1904.29(b)(3): You must enter each recordable injury or illness on the OSHA 300 Log and 301 Incident Report within seven (7) calendar days of receiving information that a recordable injury or illness had occurred. a. For calendar year 2015, the employer did not record current injuries or illnesses on the OSHA 300 Log within seven (7) days of incident. At time of opening conference, July 28, 2015, Peter Vanden Heuvel, HR Manager, stated that he did not have an up to date OSHA 300 Log for the current year. On August 25, 2015, OSHA 300 Log was received by CSHO. Peter indicated that the incident on June 29, 2015 was a laceration of the head requiring stitches.
