29 CFR 1926.95(a): Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, was not provided whenever hazards capable of causing injury or impairment were encountered:    Dover, NH worksite - On or about July 22, 2015, an employee pouring concrete was not provided with appropriate concrete boots to protect against chemical burns to the feet from exposure to wet concrete.    Note: According to 1926.95(d)(1), protective equipment, including PPE, used to comply with 1926.95 shall be provided by the employer at no cost to employees.    Or in the alternative:    29 CFR 1926.95(b): Employee-owned equipment: Where employees provide their own protective equipment, the employer did not assure its adequacy, including proper maintenance, and sanitation of such equipment:    Dover, NH - The employer did not assure the adequacy of employee owned PPE, in that the boots used on July 22, 2015, did not adequately protect the skin against wet concrete, resulting in serious chemicals burns to the feet.

29 CFR 1910.1200(h)(3)(iii): Employee training did not include the measures employees can take to protect themselves from chemical hazards, including specific procedures the employer had implemented to protect employees from exposure to hazardous chemicals, such as appropriate work practices, emergency procedures and personal protective equipment to be used: (Construction Reference: 1926.59)    Dover, NH worksite - Hazard communication training about the specific hazards that the worker might be exposed to, and the measures that the worker could use to protect himself from these hazards, such as PPE, work practices, and emergency procedures, had not been provided in the detail required for this worker who started on 7/14/15, and was assigned to pouring concrete on or before 7/22/15.    Abatement note: Employee training must include:  When PPE is necessary; What PPE is necessary; the proper care, maintenance, useful life and disposal of the PPE; and each affected employee must demonstrate an understanding of the training, and the ability to use PPE properly, before being allowed to perform work requiring the use of PPE.
