29 CFR 1910.23(c)(1): Open-sided floors and/or platforms four feet or more above adjacent floor or ground level were not guarded with standard railings (or equivalent) and toeboards:Note: Toeboards are only required when persons can pass, there is moving equipment or there is equipment with which falling materials could create a hazard. At the time of the inspection, the open sided work platform for the "Condux" machine did not have a complete guard rail system to prevent exposure to a fall of greater than 63 inches to the concrete floor below.

29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use: At the time of the inspection, employees were instructed to wear dust masks for nuisance dust while working in areas where dust was generated such as the condux processing room. The employer had not implemented a respirator program.
