29 CFR 1910.217(c)(3)(iii): Presence sensing point of operation device(s) used on mechanical power press(es) did not protect the operator by preventing and/or stopping normal stroking of the press if the operators hands were inadvertently placed in the point of operation:    (a) Production : Employees were exposed to amputation hazards from the Niagara straight side press #2.  Openings allowing access to the point of operation were not adequately protected by the presence sensing device (light curtain) or any guard. Employees were able to pass through the sensing field and were no longer detected or protected by the light curtain.     On August 17, 2013 an employee suffered an amputation injury to their left hand when the Niagara straight side press #2 cycled while an employee was retrieving a part from the point of operation.      In accordance with the requirements of 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete and must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase, or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1910.217(e)(1)(ii): Mechanical power press(es) were not inspected and tested at least weekly to determine the condition of the clutch/brake mechanism, anti repeat feature, and single stroke mechanism of mechanical power press(es) were not maintained:    Note:  Inspection of the clutch/brake mechanism, anti-repeat feature and single stroke mechanism is not required on machines using part revolution clutches if control reliability and brake system monitoring are installed which comply with paragraphs (b)(1      (a) Production - The employer did not conduct testing or weekly inspections of the Niagara straight side press #2 to determine the condition of the clutch/brake mechanism, anti repeat feature, and single stroke mechanism of mechanical power press.
