29 CFR 1926.28(a): The employer did not require the wearing of appropriate personal protective equipment in all operations where there is an exposure to hazardous conditions or where this part indicates the need for using such equipment to reduce the hazards to the employees: South and west sides of construction: On or about September 28, 2015, an employee was exposed to the hazard of being struck by flying projectiles, while welding fascia onto a roof without the use of eye and face protection.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems: South side of construction: On or about September 28, 2015, an employee was exposed to a fall hazard greater than 6 feet to the ground level below, while as he was leaning over the leading edge, welding without the use of fall protection equipment or an alternative fall protection plan.
