OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: (a) On or about October 7, 2015, at the above addressed worksite, employees were working next to and below an elevated Port-A-Cool evaporative cooling unit which was not on a platform recommended by the manufacturer that was well constructed, stable and would prevent the unit from being tipped over, exposing the employees to a struck by hazard.
