Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm in that employees were exposed to slip and trip hazards at an emergency exit for the emergency reclaim coal pit: a. On or about October 22, 2015, at the coal yard, the outside sloped secondary access of the emergency reclaim coal pit did not have handrails on either side of the walking surface. b. On or about October 22, 2015, at the coal yard, the outside sloped secondary access of the emergency reclaim coal pit was not designed to minimize water accumulation on the walking surface due to weather events such as rain or snow.

29 CFR 1910.36(h)(3): Outdoor exit route(s) were not reasonably straight and did not have smooth, solid, substantially level walkways: On or about October 22, 2015, at the coal yard, a substantially level walking surface was not provided at the outside secondary access of the emergency reclaim coal pit in that the sloped concrete walking surface was concave in shape. Employees were exposed employees to slipping hazards during fire emergencies.

29 CFR 1910.23(c)(1)(i): 29 CFR 1910.23(c)(1)(i): Every open-sided floor or platform 4 feet or more above adjacent floor or ground level was not guarded by a standard railing (or the equivalent as specified in paragraph (e)(3) of this section) with a toeboard wherever, beneath the open sides, persons can pass: On or about October 22, 2015, coal stacker, a toeboard was not present at an open side of a platform that led to stairs. Employees walking on the ground near the platform were exposed to struck-by hazards from objects or materials being kicked from the platform.
