29 CFR 1926.453(b)(2)(v): A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift: On or about October 23, 2015, employee operating an aerial lift was not wearing any type of fall protection. Employee was bringing material to the upper levels. This condition exposed employee to falls greater than 10 feet. Premier Construction was previously cited for a violation of this Occupational Safety and Health Standard 1926.453(b)(2)(v), which was contained in OSHA inspection number 1061441, citation number 1, item number 2 and was affirmed as a final order on July 21, 2015, with respect to a workplace located at 900 Sunland Park El Paso, TX.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. On or about October 23 , 2015, employer did not ensure that a guard rail was installed by the window opening. Employee was removing material from the upper floor without fall protection equipment or guardrail system. This condition exposed employee to fall exceeding 6 feet.
