29 CFR 1926.405(g)(2)(iv): Flexible cords were not connected to devices and fittings so that strain relief is provided to prevent pull from being directly transmitted to joints or terminal screws: a) On or about 10/27/15 at 5130 East Main Street, Batavia, NY; employer failed to protect employee from contact with energized electric equipment when the conductors on the male end of the pump sprayer plug were exposed and the insulation pulled away. NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.453(b)(2)(v): A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift: Note: As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated; a) On or about 10/27/15 at 5130 East Main Street, Batavia, NY; employer failed to protect employee from a fall hazard when they did not provide and require the use of personal fall arrest system (harness and lanyard attached to an anchor point) while using an aerial lift to perform spray painting on the east side of the building. NO ABATEMENT CERTIFICATION REQUIRED
