OSH ACT of 1970 Section (5)(a)(1):   Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employee(s) were exposed to the hazard of not wearing seat belts while operating a powered industrial truck:  JOB SITE: 9624 Manchester Road, Saint Louis, MO 63144, on or about, 11/4/2015, during out walk around with the Yard Manager, powered industrial truck operators were observed operating the powered industrial truck without wearing their seat belts.  One operator had the seat belt secured in the rear of the operator's seat.

29 CFR 1910.178(q)(7): Industrial trucks were not examined before being placed in service:  JOB  SITE: 9624 Manchester Road, Saint Louis, MO 63144, on or about 11/4/2015, located in the supply yard, forklift operators are operating their power industrial truck and are not being examined before being placed in service.  The operators used their power industrial truck to unload and load large volumes of material throughout the day.
