(a)Prairie Winds Construction, LLC @ 21006 48th Ave., Eklton, SD 57026: On or about November 3, 2014, as part of the injury/accident prevention responsibilities, the exposing employer did not ensure each employee who was allowed to operate the All-Terrain Forklift (Lull model # 644E42) was trained in the safe operation as required under the standard. Employees operated the rough terrain forklift without receiving training to ensure that each operator is competent to operate a powered industrial truck. This condition exposed employees to the hazard of improper forklift operation.        29 CFR 1926.602(d): Powered industrial truck operator training. Note: The requirements applicable to construction work under this paragraph are identical to those set forth at 29 CFR 1910.178(l) of this chapter.       Abatement Note:  Training shall consist of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace.

29 CFR 1926.451(c)(2)(iv): Front-end loaders and similar pieces of equipment shall not be used to support scaffold platforms unless they have been specifically designed by the manufacturer for such use.    (a)Prairie Winds Construction, LLC @ 21006 48th Ave., Elkton, SD 57026: On or about November 3, 2015, the exposing employer did not ensure employees were protected from serious injury by the use of an elevated work platform which was not designed, constructed, or used in accordance with the requirements of the manufacturer. The employer utilized the forklift platform in the construction of a pole barns. The platform was not specifically designed by the manufacturer and did not meet ASME B56.6a-1994 requirements. The platform exceeded criteria for the overall length, was not secured to the mast, and did not have a data plate identifying maximum working load including personnel and equipment. This condition exposed employees to fall hazards and crushing hazards related to the platform separating from the mast.     Abatement Note: Among other methods, one feasible and acceptable abatement method to correct this hazard is to ensure that all platforms used for elevating personnel with a rough terrain forklift truck comply with the design requirements specified in ASME B56.6a-1994, American Society of Mechanical Engineers, "Safety Standards for Rough Terrain Forklift Trucks",  Section 8.25, Platforms for Elevating Personnel, in the following areas: (1)Paragraph (b) which states, "floor dimensions which shall not exceed two times the load center distance listed on the rough terrain forklift truck nameplate, measured parallel to the longitudinal center plane of the truck, nor have a length greater than the overall width of the truck measured across the load bearing tires plus 10 in. (250 mm) on either side. (2)Paragraph (f) which states, "information prominently indicated on the platform: (1) maximum work load including personnel and equipment; (2) weight of empty platform." The employer had not implemented a conventional protection system on the roof, but relied upon a scissors lift positioned at the eave to protect the employee from fall hazards. As a result, an employee fell approximately 16 feet to the ground below and sustained life threatening injuries. This condition exposed employees to a fall hazard of approximately 16 feet.

Employees engaged in roofing activities worked near the edge of a two-story residential home without the use of a fall protection system. This condition exposed employees to a fall in excess of 25 feet.       Abatement Note: The employer shall assure that each employee has been trained, as necessary, by a competent person qualified in the following areas:     (a)  The nature of fall hazards in the work area;     (b)  The correct procedures for erecting, maintaining, disassembling, and inspecting the fall protection systems to be used;     (c)  The use and operation of guardrail systems, personal fall arrest systems, safety net systems, warning line systems, safety monitoring systems, controlled access zones, and other protection to be used;     (d)  The role of each employee in the safety monitoring system when this system is used;     (e)  The limitations on the use of mechanical equipment during the performance of roofing work on low-sloped roofs;     (f)  The correct procedures for the handling and storage of equipment and materials and the erection of overhead protection; and     (g)  The role of employees in fall protection plans;      (h)  The standards contained in this subpart.     Abatement Note: 1926.503(b)(1) provides that the employer shall verify compliance with paragraph (a) of this section by preparing a written certification record. The written certification record shall contain the name or other identity of the employee trained, the date(s) of the training, and the signature of the person who conducted the training or the signature of the employer. If the employer relies on training conducted by another employer or completed prior to the effective date of this section, the certification record shall indicate the date the employer determined the prior training was adequate rather than the date of actual training.
