29 CFR 1926.651(k)(2): When the competent person found evidence of a situation that could result in a possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employees were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety: a) 1700 Girrard St., NE - On or about 11/04/2015, the competent person working with a crew of construction workers installing underground utilities did not remove the workers from a 7 foot deep excavation which contained a wooden trench shield having a damaged structural member In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet), in addition, documentation demonstrating the abatement is complete must be included with your certification. This documentation may include, but is not limited to evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
