29 CFR 1926.651(k)(2): When the competent person found evidence of a situation that could result in a possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employees were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety:   a)  1700 Girrard St., NE - On or about 11/04/2015, the competent person working with a crew of construction workers installing underground utilities did not remove the workers from a 7 foot deep excavation which contained a wooden trench shield having a damaged structural member  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet), in addition, documentation demonstrating the abatement is complete must be included with your certification.  This documentation may include, but is not limited to evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c).   a)  1700 Girrard St., NE  On or about 11/04/2015, a construction worker was exposed to a crushing hazard while installing a fire hydrant and occupying a 7 foot deep excavation where a protective system had not been provided.   In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet), in addition, documentation demonstrating the abatement is complete must be included with your certification.  This documentation may include, but is not limited to evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1926.652(d)(3): When material or equipment that was used for protective systems is damaged, a competent person did not examine the material or equipment and evaluate its suitability for continued use; and if a competent person cannot assure the material or equipment is able to support the intended loads or is otherwise suitable for safe use,  such material or equipment was not removed from service and  evaluated and approved by a registered professional engineer before being returned to service.  a)  1700 block of Girrard St., NE - On or about 11/04/2015, a 4 inch by 4 inch horizontal structural member, which was a part of a wooden trench shield being used in a utility installation operation, was fractured.    In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet), in addition, documentation demonstrating the abatement is complete must be included with your certification.
