29 CFR 1926.651(h)(1): Employees were working in excavations in which there was accumulated water, or excavations in which water was accumulating, and adequate precautions had not been taken to protect employees against the hazards posed by water accumulation:      a)  Lot 148 - On or about December 21, 2015 and at times prior thereto, employees were working in an unprotected trench between 6' and 8' in depth in order to repair a broken water line.  A water pump was being used, but it was not adequate enough and water continued to accumulate.

A water pump was being used, but it was not adequate enough nor being monitored by a competent person and water continued to accumulate.

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions:      a)  Lot 148 - On or about December 21, 2015 and at times prior thereto, employees were working in an unprotected trench between 6' and 8' in depth in order to repair a broken water line.  A water pump was being used, but it was not adequate enough and water continued to accumulate.  There was no competent person on site to perform inspections of the trench.
