29 CFR 1910.106(e)(2)(iv)(c): Category 1 or 2 flammable liquids, or Category 3 flammable liquids with a flashpoint below 100 °F (37.8 °C), may be used only where there are no open flames or other sources of ignition within the possible path of vapor travel. The employer did not ensure that adequate precautions were taken to prevent the ignition of flammable vapors from sources such as open flames and hot surfaces. The employee placed an aerosol can of Krylon Color Master Primer, a category 1 flammable liquid, in front of a heater resulting in a fire. Employees were potentially exposed to smoke inhalation and burn hazards.

29 CFR 1910.1200(e)(1): Employers shall develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, material safety data sheets, and employee information and training will be met, and which also includes the following. a) The employer had not developed a written hazard communication program for employees performing tasks such as, spray painting. Employees using products, such as, but not limited to Krylon Color Master Primer were potentially exposed to skin and respiratory inhalation hazards. b) The employer did not provide hazard communication training for employees performing tasks such as, spray painting. Employees using products, such as, but not limited to Krylon Color Master Primer were potentially exposed to skin and respiratory inhalation hazards. c) The employer did not maintain safety data sheets for employees performing tasks such as, spray painting. Employees using products, such as, but not limited to Krylon Color Master Primer were potentially exposed to skin and respiratory inhalation hazards.
