OSH ACT of 1970 Section (5)(a)(1): Section 5(A)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or were likely to cause death or serious physical harm to employees in that employees were exposed to: Crushing hazards as an employee was operating a powered industrial truck at a construction site was not wearing a seat belt.    a) Throughout jobsite-On or about January 26, 2016, an employee was operating a JCB, Telehandler forklift (VIN 5CEKGC01402357) without the use of seatbelts, exposing the employee to ejection, and others to struck-by and crushing hazards.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a)     Jobsite Unit 5 - On or about January 26, an employee was exposed to an eleven feet fall hazard when working from an open sided 2nd level porch/patio without fall protection.
