29 CFR 1926.52(d)(1): In all cases where the sound levels exceeded the values shown in Table D-2 of 29 CFR 1926.52, a continuing, effective hearing conservation program was not administered: a) On or about January 28, 2016, the employer did not establish and maintain an annual audiometric testing program for all employees whose exposures equal or exceed an 8-hour time weighted average of 90 dBA as part of an effective hearing conservation program. Personal noise monitoring by OSHA revealed that an employee was exposed to eight hour time weighted average for noise levels of 104.9 dBA while cutting brick with a wet saw. b) On or about January 28, 2016, the employer did not monitor employee's noise exposures to determine the appropriate engineering or administrative control to implement. The employer did not conduct personal noise monitoring to ensure proper precautions were taken to protect the employees.
