OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to entrapment of the head and torso between the truck and the ground: On or about February 11, 2016, the employer did not ensure that employees authorized to operate powered industrial vehicles used an active operator protection device or system, when provided. Abatement certification is required for this item in accordance with the requirements of 29 CFR 1903.19(c).

29 CFR 1910.147(c)(4)(i): Procedures were not developed, documented, and utilized for the control of potentially hazardous energy when employees were engaged in activities covered by this section: The employer failed to develop and implement procedures that clearly and specifically: 1. Outline the steps to be followed 2. Techniques to be used 3. Actions to be taken by the employer to ensure that the control measures are utilized by employees. Employees were exposed to injuries, such as amputations and fractures, while performing servicing and maintaining the headers and threaders. Abatement certification is required in accordance with the requirements of 29 CFR 1903.19(c).
