29 CFR 1910.134(h)(2)(i): Respirators were not stored to protect them from damage, contamination, dust, sunlight, extreme temperatures, excessive moisture, and damaging chemicals:    On or about March 02, 2016, at the Jamul Casino Project, the employer did not ensure employee assigned respirators were stored in a convenient, clean and sanitary location.    1) An MSA half-face respirator was observed hanging from the control panel of the man lift unprotected from contamination.    2) An MSA half-face respirator was observed hanging of the side of a rolling scaffold unprotected from contamination.

29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: (Construction Reference 1926.103)      On March 02, 2016, and times prior to at the Jamul casino project, the employer, JT Wimsatt, did not provide a medical evaluation to determine an employee's ability to use a respirator before the employee is required to use it in the workplace, such as, but not limited to, the employee using an MSA half-face respirator when working with rapid set cement.
