OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees:    a)  On or about March 1, 2016, during picking orders, located in the warehouse of Building 18, the employer did not ensure that a fall protection system was used by employees who were exposed to a 10 foot fall hazard from the top of the Clark Orderpicker, Model #OP15 with Serial#OP15-0173-PM9293 to the concrete floor below.

29 CFR 1910.178(l)(3)(i)(A): Powered industrial truck operators did not receive initial training on operating instructions, warnings, and precautions for the types of truck the operator would be authorized to operate:    a)  On or about March 1, 2016, during picking orders, located in the warehouse of Building 18, the employer did not ensure that employees receive initial training on operating instructions, warnings, and precautions for the Clark Orderpicker, Model #OP15 with Serial#OP15-0173-PM9293, that employees would be authorized to operate.
