29 CFR 1926.451(e)(1): A means of access for scaffold platforms more than 2 feet (0.6 m) above or below a point of access, such as portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surface was not used:    a) On or about 3/14/16 at a residential construction project located at 61 John Alex Drive, West Seneca, New York; employees were using a ladder jack scaffold, with the scaffold brackets and platform to the outside of the supporting ladders. The employees had to access the platform by climbing the supporting ladders and climbing around the bracket and platform.    NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.451(g)(1)(i): Each employee on a boatswains' chair, catenary scaffold, float scaffold, needle beam scaffold, or ladder jack scaffold was not protected by a personal fall arrest system:    a) On or about 3/14/16 at a residential construction project located at 61 John Alex Drive, West Seneca, New York; employees were using a ladder jack scaffold to perform work and access the roof. The platform height was approximately 11 feet and there was no personal fall arrest system in place.    NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.501(b)(11): Each employee on a steep roof with unprotected sides and edges 6 feet or more above lower levels was not protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems:    a) On or about 3/14/16 at a residential construction project located at 61 John Alex Drive, West Seneca, New York; employees were installing shingles on the roof of a 1 story house with a 7 in 12 roof pitch and an eave height of up to approximately 15 feet. There was no fall protection in use.    NO CERTIFICATION ABATEMENT REQUIRED

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:    a) On or about 3/14/16 at a residential construction project located at 61 John Alex Drive, West Seneca, New York; an extension ladders was used for access to the roof at the front and rear of the house. The ladder at the rear of the house extended 1 foot above the eaves and at the ladder at front of the house was approximately 2 feet above the eaves.    NO ABATEMENT CERTIFICATION REQUIRED    Besroi Construction Corporation was previously cited for a violation of this occupational safety and health standard which was contained in OSHA inspection number 190785, citation number 1, item number 2 and was affirmed as a final order on 2/28/12, with respect to a workplace located at 366 Lakefront Boulevard, Buffalo, New York.
