29 CFR 1910.178(q)(1): Any power-operated industrial truck not in safe operating condition shall be removed from service. All repairs shall be made by authorized personnel.    a. On or about March 14. 2016, in the facility, employees were required to operate forklift trucks that were not in safe operating condition.  Thereby exposing employees to struck-by hazard(s).     1. Forklift- Mitsubishi Caterpillar/ Serial number 5BM01709/ Model Number DP25/ Locally tagged and stenciled with number "30"- Audible horn was inoperable and left rear and right rear tires were severely worn.

29 CFR 1904.39(a)(2): Basic Requirement. Within twenty-four (24) hours after the in-patient hospitalization of one or more employees or an employee's amputation or an employee's loss of an eye, as a result of a work-related incident, you must report the in-patient hospitalization, amputation, or loss of an eye to OSHA.     a. On or about March 10, 2016, the employer did not contact OSHA within 24 hours when an employee at the facility sustained a work-related injury and was admitted to the hospital as an in-patient hospitalization.
