29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 191 0.95(c) through (o) whenever employee noise exposures equal or exceed an 8-hour Time-Weighted Average (TWA) sound level of 85 decibels measured on the A scale (dBA), or equivalently a dose of fifty percent:  An effective hearing conservation program which included noise monitoring, audiometric testing of employees, training of employees, and retention of exposure measurements as detailed in the standard was not instituted by the employer.  a) In the Spray Area, a Spray Tech was exposed to continuous noise of 98.1 dBa or the equivalent noise dose of 311% during the 464 minute sampling period on April 6, 2016.  b) In the Spray Area, a Spray Tech was exposed to continuous noise of 93.8 dBa or the equivalent noise dose of 169.6% during the 389 minute sampling period on April 14, 2016.  c) In the Spray Area, a Spray Tech was exposed to continuous noise of 92.4 dBa or the equivalent noise dose of 140.4% during the 469 minute sampling period on April 6, 2016.  d) In the Spray Area, a Spray Tech was exposed to continuous noise of 89 dBa or the equivalent noise dose of 87.9% during the 478 minute sampling period on April 14, 2016.

29 CFR 1910.134(c)(2)(i): Respirator users were not provided with the information contained in Appendix D to 29 CFR 1910.134 when the employer determined that any voluntary respirator use was permissible:    a) On or about April 4, 2016, throughout establishment, the employer did not provide the basic advisory information on respirators, as presented in Appendix D of 29 CFR 1910.134, in written or oral format to employees who wore N95 dust masks on a voluntary basis, when the employer determined that voluntary use was permissible.
