29 CFR 1926.451(f)(7): Scaffolds shall be erected, moved, dismantled, or altered only under the supervision and direction of a competent person qualified in scaffold erection, moving, dismantling or alteration. Such activities shall be performed only by experienced and trained employees selected for such work by the competent person. Located along the perimeter exterior ground level area of the apartment structure adjacent to the intersection of East Corry and Euclid a self-supported tubular welded frame scaffolding system was erected and used without standard guardrails or personal fall arrest systems on which a competent qualified competent person did not supervise the erection of the scaffold system prior to scaffold utilization.

29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet (3.1 m) above a lower level shall be protected from falling to that lower level. Paragraphs (g)(1)(i) through (vii) of this section establish the types of fall protection to be provided to the employees on each type of scaffold. Paragraph (g)(2) of this section addresses fall protection for scaffold erectors and dismantlers. Located along the perimeter exterior ground level area of the apartment structure adjacent to the intersection of East Corry and Euclid employees were observed performing masonry work from a self-supported tubular welded frame scaffolding system on which the employees were not protected from falling by standard guardrails or personal fall arrest systems exposing employees to fall hazards in excess of 15 feet.

Located along the perimeter exterior apartment structure adjacent to the intersection of East Corry and Eden an employee was observed working from within the basket of a Genie Z-60/34 self-propelled extensible and articulating boom aerial lift without a lanyard attached to the boom or basket and was exposed to a fall hazard in excess of 20 feet.
