29 CFR 1910.178(a)(4): Modifications and additions which affect capacity and safe operation of powered industrial truck were performed by the employer without the manufacturer's prior written approval:   a) Sheet Metal Engineers, Inc.-  Production Area - Employees were exposed to a struck-by hazard - The employer modified the forks of the Hyster propane powered forklift by welding additional forks at the end of the existing forks which could affect the lifting capacity.  The employer did not obtain prior written approval from the manufacture to modify and/or add to the forklift from it's original design, on or about 06/08/16.    b) Sheet Metal Engineers, Inc.-  Production Area - Employees were exposed to crushing and struck-by hazards.  The employer fabricated a shop-made I-beam (lifting apparatus) with a scale and chokers to lift 9,000-10,000 pounds for weighing.  The employer did not obtain prior written approval from the manufacture to modify and/or add to the forklift from it's original design, on or about 06/08/16.  In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1910.178(a)(2): The employer acquired and used a powered industrial truck, manufactured after 1969, that did not meet the design and construction requirements established by the American National Standard Institute (ANSI) for Powered Industrial Trucks, Part II (ANSI B56.2-1969) which is incorporated by reference as specified in 1910.6:   Sheet Metal Engineers, Inc. -  Employees were allowed to operate a Yale powered industrial truck (forklift) that did not have a nameplate that correctly identified the forklifts manufacturers name, and truck weight and whether accepted by a national recognized testing lab (NRTL) as required by ANSI B56.1-1969, Part II, Section 405.  In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
