Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by hazard created by ejected parts. (a) Production Floor - On or about June 16, 2016, the employer failed to provide effective safeguarding by distance as a means of protecting employees from point of operation hazards of the press brakes when other physical guards or devices were not feasible. Abatement Note: Among other feasible means of abatement, the employer may implement a safeguarding by distance program which include exposure prevention procedures, employee training, and managerial enforcement of these procedures. Guidance for the creation of this program documentation is delineated in OSHAs CPL 02-01-025, Guidelines for Point of Operating Guarding of Press Brakes, under Paragraphs F through J. Additionally, safeguarding by distance protocols are outlined in ANSI B11.3-1982, Safety Requirements for Press Brakes.

29 CFR 1910.212(a)(1): Machine guarding was not provided to protect operator(s) and other employees from hazard(s) created by flying parts: a) Production Floor - On or about June 16, 2016, employees using a Cincinnati Hydraulic Press Brake to straighten three-quarter inch steel plates, placed a carbon steel block and one or more pieces of metal banding strips between the punch and the work piece resulting in struck-by hazards created by the displacement and ejection of the metal banding strips.

29 CFR 1910.147(c)(6)(i): The employer did not conduct a periodic inspection of the energy control procedure at least annually to ensure that the procedure and the requirement of this standard were being followed: (a) Throughout Facility - On or about June 16, 2016, where the employer has developed written procedures for the control of hazardous energy sources, a periodic inspection of the procedures was not conducted at least annually. Abatement Note: Where lockout is used for energy control, the periodic inspection shall include a review, between the inspector and each authorized employee, of that employee's responsibilities under the energy control procedure being inspected.1910.147(c)(6)(i)(D) Where tagout is used for energy control, the periodic inspection shall include a review, between the inspector and each authorized and affected employee, of that employee's responsibilities under the energy control procedure being inspected, and the elements set forth in paragraph (c)(7)(ii) of this section.1910.147(c)(6)(ii) The employer shall certify that the periodic inspections have been performed. The certification shall identify the machine or equipment on which the energy control procedure was being utilized, the date of the inspection, the employees included in the inspection, and the person performing the inspection.
