29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:      (a)  Roadway Safety Solutions, LLC, Eastbound I-76 near mile marker 108, Atwood, CO: On and prior to June 28th, 2016, the employer did not instruct employees in the avoidance of struck-by hazards associated with passing motorists.  An employee used a company vehicle to pick up and move advance warning signs previously placed face down off the shoulder of an active highway. The employee parked a flatbed truck approximately 12 inches away from an active traffic lane on Interstate 76.  When the employee was entering the driver side of the company vehicle, a passing motorist struck and seriously injured the employee.  This condition exposed employees to struck-by hazards.

29 CFR 1926.50(b):  Provisions were not made prior to commencement of the project for prompt medical attention in case of serious injury:     (a)  Roadway Safety Solutions, LLC, Eastbound I-76 near mile marker 108, Atwood, CO:  Prior to the start of the 13 mile long Interstate 76 resurfacing project that began in March of 2016, the employer did not ensure that employees were capable of contacting emergency medical services in the event of a serious injury.  On or about June 28th, 2016, a motorist struck and injured an employee picking up a sign on the shoulder of the highway.  The employer did not provide a means of contacting emergency services.  This condition exposed employees to the hazard of the lack of prompt medical attention and the potential for physical injury.

29 CFR 1926.50(c): A person who has a valid certificate in first-aid training was not available at the work-site to render first-aid:   (a) Roadway Safety Solutions, LLC, Eastbound I-76 near mile marker 108, Atwood, CO:  Prior to the start of the 13 mile long Interstate 76 resurfacing project that began in March of 2016, the employer did not ensure that employees received adequate first aid training.  On or about June 28th, 2016, an employee with first aid training was not available to provide emergency first aid services to an employee struck and injured by a passing motorist.  This condition exposed employees to the hazard of the lack of prompt medical attention and the potential for physical injury.
