Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall and/or struck-by hazards:      (a) On or about June 27, 2016 for the employee who sustained serious injuries when they fell approximately nine feet while riding in the bucket of a Caterpillar, model 345D, hydraulic excavator at the intersection of 48th Street SE and 160 Avenue SE, Davenport, North Dakota.      Abatement Note: Among other methods, one feasible and acceptable abatement method to correct the hazard would be to follow the general safety requirements outlined in the Caterpillar 345D Operators Manual and the Association of Equipment Manufactures (AEM) Safety Manual for Hydraulic Excavator (HE-1004, April 2010).
