29 CFR 1910.252(a)(3)(i): Welding, cutting, or other hot work was performed on used drums, barrels, tanks, or other containers that had not been cleaned so thoroughly as to make absolutely certain there were no flammable materials present or any substances such as greases, tars, acids, or other materials which where subjected to heat, might produce flammable or toxic vapors: a. In the welding department's gouging booth, on or about August 8, 2016, the employer did not ensure that an electrical transformer was cleaned so thoroughly as to make absolutely certain there were no flammable materials present, which directly resulted in an explosion and the fatal injury of the employee who was allowed to conduct reverse welding (gouging) operations on the unclean container.

Public Health Service current at the time these evaluations and procedure took place: a. At the Plant, on or about August 8, 2016, four (4) employees who were expected to provide first-aid services to injured co-workers were potentially exposed with an occupational exposure to bloodborne pathogens because the employer did not provide the Hepatitis B vaccination series in accordance with the recommendations of the US. Public Health Service, exposing these employees to contracting the Hepatitis B virus.
