29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.95(c) through (o), whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level (TWA) of 85 decibels measured on the A scale (slow response) or, equivalently, a dose of fifty percent: (a) On or about 08/19/2016 at Transit Mix Corp., yard employees were exposed to noise hazards during the chipping of concrete mixer barrels because the employer failed to implement an effective and continuing hearing conservation program. The following are instances where the time-weighted average exceeded 85 dBA: (1) A yard worker was exposed to 107.2% of the dose, which is equivalent to 90.5 dBA, during a period of 142 minutes. Zero exposure was assumed for 338 minutes.

29 CFR 1910.146(c)(4): When the employer decided that its employees would enter permit spaces, the employer did not develop and implement a written permit space entry program that complied with 29 CFR 1910.146: (a) On or about 08/19/2016 at Transit Mix Corp., yard employees were exposed to caught in and struck-by hazards during the chipping of concrete mixer barrels and during cement removal from wells because the employer allowed entry into these permit spaces and did not implement a confined space entry program.
