29 CFR 1926.1053 (b)(1): When portable ladders were used for access to an upper landing surface, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access. A. Louis Hernandez Martinez DBA HDZ Roofing worksite located at 5318 Dubois St., Toledo, Ohio: On or about August 29, 2016, the employer did not ensure the side rails of the extension ladder was extended at least three feet above the landing surface. Three employees were exposed to falls while using the ladder to access the roof to perform weatherproofing on the single story residential structure.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels is not protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. A. Louis Hernandez Martinez DBA HDZ Roofing, at the address of 5318 Dubois St., Toledo, Ohio: The employer does not require the use of any form of fall protection during roofing work. The violation was most recently observed on August 29, 2016, where employees are not protected from a 10 foot fall to the ground below. To abate this hazard the employer must ensure that its employees performing roofing work are protected from falls, and no employees are allowed onto a roof more than 6 feet high without adequate fall protection.
