29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: (a) New residential construction, Third floor window: On or about September 7, 2016, and at times prior, the employer exposed employees to fall hazards of 25-feet, from the third floor window, in that a fall protection system was not provided to employees while preparing the rough window opening for new window installation.

29 CFR 1926.1052(c)(1)(ii): Stairways having four or more risers or rising more than 30 inches (76 cm), whichever is less, were not equipped with a stairrail system along each unprotected side or edge: (a) New residential construction, Stairway: On or about September 7, 2016, and at times prior, the employer exposed employees to fall hazards up 56-inches to the lower concrete surface, in that stair rails were not installed along the open side of the stairway which was 7 risers high with no temporary stair rails provided to prevent falls from the stairway being used to access the upper level.
