29 CFR 1910.178(n)(1): All traffic regulations shall be observed, including authorized plant speed limits. A safe distance shall be maintained approximately three truck lengths from the truck ahead, and the truck shall be kept under control at all times. a. On or about September 20, 2016, a forklift operator was unable to maintain control of a Jungheinrich EFG218 battery powered forklift while traveling with the forks raised approximately seventeen feet in the air, thereby exposing the operator and employees working nearby to a crushed by hazard.

29 CFR 1910.178(l)(1)(i): The employer shall ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l). a. On or about June 6, 2016 and throughout two days prior, the employer permitted a trainee to operate a Jungheinrich EFG218 battery powered forklift without direct supervision, thereby exposing employees to a struck by hazard.
