29 CFR 1910.23(c)(1): Open-sided floors and/or platforms four feet or more above adjacent floor or ground level were not guarded with standard railings (or equivalent) and toeboards: Note: Toeboards are only required when persons can pass, there is moving equipment or there is equipment with which falling materials could create a hazard. At the hot asphalt mixing plant, employees were exposed to fall hazards in the following locations: a. at the top of the asphalt plant storage silo, a guardrail was removed and an employee was not tied off exposing the employee to an approximately 30 feet fall to the ground below. b. at the asphalt plant storage silo, employees accessed the upper level of the silo using fixed ladders that had an unprotected platform exposing employees to an approximately 10 feet fall to the ground below.

29 CFR 1910.27(b)(1)(iii): The minimum clear length of rungs or cleats was not 16 inches. At the hot asphalt mixing plant, the employer did not provide an adequate fixed ladder for access and egress to the asphalt plant storage silo exposing employees to fall hazards of approximately 10 feet to the ground below.

29 CFR 1910.178(a)(4): Modifications and additions which affect capacity and safe operation of powered industrial truck were performed by the employer without the manufacturer's prior written approval. At the hot asphalt mixing plant, employees operated a Caterpillar telescoping fork lift and used a job-made attachment on the forks that was not approved by the manufacturer to lift a gear box to an upper level.
