29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: (a) Welding area: On or about October 4, 2016 and at times prior thereto the employer failed to establish a written hazard communication program which describes how the criteria specified in 29 CFR 1910. 1200(f), (g), and (h) will be met for compressed argon gas, compressed carbon dioxide gas both of which acts as simple asphyxiant and welding wire which may cause allergic skin reaction, breathing difficulty and may cause damage to respiratory system.

29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area: (a)Welding area: On and about October 4, 2016 and at times prior thereto the employer failed to provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment. Employees used different products that contained hazardous chemicals such as but not limited to welding consumables which contains different types of hazardous metals; compressed argon gas and compressed carbon dioxide gas which acts as a simple asphyxiant.
