29 CFR 1910.134(c)(2)(i): Respirator users were not provided with the information contained in Appendix D to 29 CFR 1910.134 when the employer determined that any voluntary respirator use was permissible: (Construction Reference 1926.103)  The employer allowed the use of N-95 type paper masks at the discretion of the employees during masonry operations without providing the information contained in Appendix D of 1910.134 as required.

29 CFR 1910.178(l)(6): The employer did not certify that each operator had been trained and evaluated as required by paragraph (l) through a certification that included the name of the operator, the date of the training, that date of evaluation, and the identity of the person(s) performing the training or evaluation:  The employer did not ensure that a certification was created to document the forklift operator's previous training and the operator evaluation that was performed by the company president.
