29 CFR 1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person (i.e., a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them): (a)Big Eagle Construction, Inc. @ 48198 215th St. Elkton SD, 57026: On and prior to October 28th, 2016, the exposing employer did not ensure a safety program was developed and implemented for the work environment to include regular inspections of the job-site, materials, and equipment; conducted by a competent person. Employees were installing metal roof panels while exposed to a fall hazard of approximately 21 feet. Abatement Note: OSHA defines a "competent" person as one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them.

29 CFR 1926.760(a)(1): Except as provided by paragraph (a)(3) of this section, each employee engaged in a steel erection activity who is on a walking/working surface with an unprotected side or edge more than 15 feet (4.6 m) above a lower level shall be protected from fall hazards by guardrail systems, safety net systems, personal fall arrest systems, positioning device systems or fall restraint systems. (a)Big Eagle Construction, Inc. @ 48198 215th St. Elkton SD, 57026: On and prior to October 28th, 2016, the employer did not ensure each employee on a walking/working surface having an unprotected side or edge which was 15 feet or more above a lower level was protected from falling by the use of a guardrail system, a safety net system, or personal fall arrest system. Employees were installing metal roof panels without the use of a fall protection system. On October 28th, 2016, an employee fell approximately 21 feet while installing metal roof panels. This condition exposed employees to fall hazards of approximately 21 feet.

The employer shall institute a training program and ensure employee participation in the program. (a)Big Eagle Construction, Inc. @ 48198 215th St., Elkton SD, 57026: On and prior to October 28, 2016, the employer did not ensure that each employee engaged in metal roof panel installation was trained to recognize the hazards of working at elevation and trained in the use of fall protection. This condition exposed employees to a fall hazard of approximately 21 feet.
