29 CFR 1910.178(m)(5)(iii): Powered industrial truck(s), with the operator dismounted and within 25 feet of the truck still in his view, did not have the load engaging means fully lowered:     On or about November 2, 2016, at the job site a forklift truck operator did not stay in the cab of the forklift truck with a personnel platform mounted to the forks and elevated approximately 14 feet high.  The operator was observed operating another forklift truck.  Employees were exposed to fall and struck by hazards.

29 CFR 1926.602(c)(1)(ii): Modifications or additions which affect the capacity or safe operation of the equipment were made without the manufacturer's written approval:    On or about November 2, 2016, at the job site an employee was observed working in a shop made platform which was mounted on an all-terrain forklift truck elevated to a height approximately 14 feet high.  The employer did not have a written approval from the forklift truck manufacturer to allow such addition/modification to the forklift.  Employees were exposed to fall and struck by hazards.
