Section 5(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to overhead struck-by hazards from an unsecured climb assist counterweight:    (a) On or about November 8, 2016 for an employee who was injured after a climb assist counterweight fell while he was working beneath it to adjust guy lines on a Crown CE 550DD servicing rig located at the Fort Berthold well site in the vicinity of the intersection of Hwy 22 & BIA 14.    Abatement note: Among other feasible and acceptable means of abatement the employer could follow the recommend practices established in API RP 54, specifically, paragraph 9.2.5 which states Prior to raising or lowering any mast, all tools and materials shall be removed from the mast.
