29 CFR 1910.178(l)(4)(i): 1910.178(l)(4)(iii): An evaluation of each powered industrial truck operator's performance shall be conducted at least once every three years: On or about November 14, 2016, and at time prior thereto, at this at meat products processing plant, employees were involved in loading and unloading heavy pallets with food products and were utilized powered industrial trucks (PITs). The employer did not evaluate his powered industrial trucks operator's performance at least once every three years for such, but not limited to: a) Raymond Powered Industrial Fork Lift Truck; b) AC-Hand Mechanic Pallet Jet Truck; and, c) Raymond Electric Pallet Jet Truck.

29 CFR 1910.132(d)(2): The employer did not verify that the required workplace hazard assessment has been performed through a written certification which included the requirements as outlined in 29 CFR 1910.132(d)(2): On or about November 14, 2016, and times prior thereto, at this establishment, employees (truck drivers and food production workers) were exposed to hazards such as, but not limited to, food products, failing wood pallets with food products, struck-by and caught-in-between, and employer did not verify and evaluated the workplace through a written certificate that a hazard assessment was performed.
